A general warranty deed is the most beneficial for the home buyer because it provides the greatest amount of protection. It's a guarantee from the current owners (also referred to as grantors) that they have full ownership of the property and have disclosed all encumbrances, liens, easements and judgments.

The warranty occurs automatically on the sale and need not be the basis for the bargain. Most implied warranties can be waived orally or in writing but must conspicuously specify the word merchantability when disclaiming that specific warranty.

A warranty of title is a guarantee by a seller to a buyer that the seller has the right to transfer ownership and no one else has rights to the property. In addition, a warranty of title may be used to guarantee that no other party has copyright, patent or trademark rights in the property being transferred.

(2) A warranty under subsection (1) will be excluded or modified only by specific language or by circumstances which give the buyerreason to know that the person selling does not claim title in himself or that he is purporting to sell only such right or title as he or a third person may have.

Under the implied category are three major subtypes: the implied warranty of merchantability (only given by merchants), the implied warranty of fitness for a particular purpose, and the implied warranty of title.

And ambiguous language will be interpreted to favor the person who did not draft the contract. A seller can, however, unless a special statute such as a lemon law provides otherwise, totally exclude or disclaim all express warranties (if it has not made an express warranty) by clear and conspicuous language.

A warranty of title also exists for the sale of goods (or a lease warranty for use and possession).Although the warranty is implicitly conveyed with the sale of the good, it is not identified as an implied warranty and may be disclaimed by a clearly communicated writing.
