Anonymous affidavits of merit are uncommon, however are being discussed in some regions. Anonymous testimony, in any form, does not permit confirmation of the expert's qualifications, authoritative expertise or potential bias.

The person making the affidavit (the deponent) must sign the bottom of each page in the presence of an authorized person, such as a lawyer.

A signature affidavit is a document in which the signatory affirms that his or her legal name is written and typed as stated in the affidavit. The affidavit is often signed in front of a notary public, who then signs the affidavit and stamps it with a notary seal.

Situation 2 If a person voluntarily files a false affidavit, then he/ she can be punished under section 191,193,195 and 199 of the Indian Penal Code for giving false evidence. Punishment for filing a false affidavit is punishable by imprisonment for a term ranging from 3 to 7 years.

Affidavit is not treated as "evidence" within the meaning of Section 3 of the Evidence Act. However, it was held by the Supreme Court that an affidavit can be used as evidence only if the court so orders for sufficient reasons, namely, the right of the opposite party to have the deponent produced for cross-examination.
