The regulation 14 CFR 91.225(e) allows aircraft not certificated with an electrical system, including balloons and gliders, not equipped with ADS-B Out to operate within 30 nautical miles of a Class B primary airport?basically, within its Mode C veil?while remaining outside of any Class B or Class C airspace.

An ADS-B Out failure doesn't require an immediate landing. Talk to ATC and come up with a plan that works for everyone. In all likelihood, you'll be able to proceed without any inconvenience. Then, get the issue fixed before flying in ADS-B airspace, or get a waiver if necessary to fly somewhere where it can be fixed.?

Aircraft not complying with the requirements may be denied access to this airspace. As described in 14 CFR 91.225, ADS-B Out performance is required to operate in: Class A, B, and C airspace. Above the ceiling and within the lateral boundaries of a Class B or Class C airspace area upward to 10,000 feet MSL .

Pilots/operators using aircraft that do not meet ADS-B Out equipage or performance requirements may request an authorization to deviate from the rule to access ADS-B Out rule airspace.
