Tenants can have visitors unless limited by the lease. Most leases will say how many days a visitor can stay overnight. Example: paragraph 2 of the Texas Apartment Association (TAA) lease allows the landlord to write in the number of days a visitor may stay in any week.

A tenant is entitled to: the right of private, peaceful possession of the property. The right to change the locks on the doors and security cameras (if you do not damage the property) prevent the owner from entering (unless there is an emergency or upon reasonable notice to make repairs)

A Florida landlord can terminate without cause a month-to-month tenancy by giving the tenant a written notice at least 15 days before the end of the monthly period. The notice must inform the tenant that the tenancy will end in 15 days and that the tenant must move out of the rental unit by that time.

Adjustments to Termination Notices A critical change in the 2023 amendments is extending the notice period for month-to-month tenancy terminations. Landlords must now provide at least 30 days written notice before the end of the monthly period, switched from the previous 15-day requirement.

For example, if the landlord wants the tenant to move out by November 1 and the rent is due on the first of each month, the landlord must give notice by September 30. In New York 5 Page 9 City, 30 days' notice is required, rather than one month.

Tenants in New York cannot be denied based on past legal conflicts with a landlord (for example, if they have previously sued a landlord). Landlords in New York are also not allowed to charge any additional fees for the processing, review, or acceptance of an application.

Landlords in Florida cannot include provisions that waive the tenant's basic rights, such as the right to a court hearing, or provisions that allow the landlord to retain the security deposit without justification. Illegal clauses that impose excessive late fees beyond what is considered reasonable are also forbidden.
