Bankruptcy exclusion Debt discharged as part of a bankruptcy is excluded from gross income.

Exceptions may allow the taxpayer to eliminate the following types of canceled debt from income: Gifts and bequests. Certain student loans (e.g., doctors, nurses, and teachers serving in rural or low-income areas) Deductible debt (e.g., home mortgage interest that would have been deductible on Schedule A)

When that obligation is subsequently forgiven, the amount you received as loan proceeds is reportable as income because you no longer have an obligation to repay the lender. The lender is usually required to report the amount of the canceled debt to you and the IRS on a Form 1099-C, Cancellation of Debt.

The IRS offers a tax debt forgiveness program for taxpayers who meet certain qualifications. To be eligible, you must claim extreme financial hardship and have filed all previous tax returns. The program is available to certain people only, so contact us to find out if you qualify.
