A Tennessee quitclaim deed form transfers the current owner's entire interest in the property with no warranty or covenants of title. The new owner (the grantee) receives whatever ownership interest the current owner (the grantor) can legally transfer.

Transfer-on-Death Deeds for Real Estate Tennessee does not allow real estate to be transferred with transfer-on-death deeds.

Per Tennessee Code § 67-4-409, the state imposes a Realty Transfer Tax on most transfers of real property. For quitclaim deeds, the amount of the tax is at a rate of $0.37 per $100 of the property's purchase price.

Joint assets owned with others also don't have to go through probate. Bank accounts, cars or real estate jointly owned are considered non-probate assets, including joint tenants and tenants by the entirety with rights of survivorship.

In order to convey any real property or an interest in property in Tennessee, the deed must be in writing, acknowledged by the grantor, and registered in the county where the property is located. The Annotated Code of Tennessee allows for the transfer of real property through the usage of a variety of deeds.

If the other owner is still alive, the property automatically passes to them under the Right of Survivorship. In this case, it is the responsibility of the executor or administrator to fill in and submit a Deceased Joint Proprietor form, along with a death certificate, to the Land Registry.

A Tennessee quitclaim deed is a legal document that conveys property from a seller to a buyer in an expeditious fashion. This document provides no guarantee that the property title is free of encumbrances and that the seller has the legal right to sell the property.

Tennessee law does not recognize transfer-on-death (TOD) deeds. In states that authorize them, TOD deeds allow real estate to automatically transfer to a named beneficiary upon the current owner's death. The advantage of TOD deeds is that they do not limit the owner's property rights during life.
