Individuals or couples can set up a charitable gift annuity. (You are the “annuitants,” which is the specific name for beneficiaries of annuities and many insurance policies.) Depending on the charity, your annuity can be funded with cash donations, but potentially also securities and gifts of personal property.

A traditional annuity is also not tax-deductible — though it may have tax implications, as some annuities provide tax-deferred earnings. A charitable gift annuity may be partially tax-deductible when funded, as the charity will eventually receive some of the proceeds.

In most instances, the payments will eventually be taxed as ordinary income. The charity that issues the annuity will send a Form 1099-R to the annuitant each year. This form will specify how the payments should be reported for income tax purposes.

As part of new legislation, SECURE Act 2.0, beginning in 2023 individuals over the age of 70 ½ will have the opportunity to use up to $50,000 of their qualified charitable distribution (QCD) to form a charitable gift annuity (CGA).

With a term-of-years gift annuity, the donor receives a charitable tax deduction and income for a period of years. As long as the annuitant elects the term-of-years option prior to the annuity starting date, the annuitant receives payments that are partially taxed as ordinary income and partially tax-free.

If the annuity is funded with appreciated securities or real estate owned more than one year, and the donor is receiving the annuity payments, part of the payments will be taxed as ordinary income, part as capital gain, and part may be tax-free.

Charitable gift annuities can be a good option for donors who want to make a charitable contribution but also want a stable source of income in return. The income payments from a charitable gift annuity may be tax-free or partially tax-free, depending on the terms of the contract and the donor's tax situation.

Charitable gift annuity donors (annuitants) receive payments for the rest of their lives.
