You are free to skip your lunch or rest break if you want to. Your employer cannot force you to take a meal break. Your employer's responsibility is to provide the opportunity for you to have an uninterrupted 30-minute meal break, but whether to take a lunch break is up to you.

Employees working 5 hours or less do not receive a meal break. Employees working 6 hours or less may waive their meal break by mutual consent of both employer and employee.

California allows you to skip meal periods without triggering legal issues for your employer if you volunteered to do so. If you don't work more than six hours, you can also skip your meal break for any reason. You may legally waive your meal break if you work more than six hours.

Yes, employees in California can officially waive their lunch breaks, but only if they work for less than six hours. Employees who choose to work through their lunch do so somewhat more unofficially. A recent California court decision changed the duty of employers to provide lunch breaks for a full day's work.

Waiver of meal period Employees may waive their meal periods only when they will complete their workday in six hours. If employees work more than 10 hours in a day, they may waive their second meal periods only if they take their first meal periods and they do not work more than 12 hours that day.

However, a meal break waiver is only allowed in very limited circumstances. If an employee's shift is six hours or less, the meal period may be waived by mutual consent of the employer and employee. So, if an employee works six-and-one-half hours, she and her employer are prohibited from a meal break waiver.

Under California's meal break law, the employer must provide employees with an unpaid meal break for every 5 hours they work. Each meal break must be uninterrupted and duty-free for at least 30 minutes duration.
