Coverage. Any full-time Federal civilian employee whose appointment is not limited to 1 year is entitled to military leave. Military leave under 5 U.S.C. 6323(a) is prorated for part-time career employees and employees on an uncommon tour of duty.

An employee is entitled to time off at full pay for certain types of active or inactive duty in the National Guard or as a Reserve of the Armed Forces.

Military Leave: What It Is and How It Works. As part of the military pay and benefits package, military service members earn 30 days of paid leave per year. You start at zero and for every month of military service, 2.5 days of leave get added to your leave account.

To request a temporary or extended military leave of absence, the employee should generally obtain a request for leave of absence form from HR. Written notice is preferred, but not required under the law or this policy.

The military leave policy is a leave of absence from work granted to employees who participate in certain active or inactive duties in the United States military, including the National Guard and Reserve of the Armed Forces.

The use of paid time off/vacation benefits is the employee's choice for military-related absences. An employer is prohibited from requiring employees to use their leave benefits for a military absence; however, the employer must allow the use of paid leave if an employee requests it. See 20 C.F.R.

Military caregiver leave allows you to take up to a total of 26 workweeks of unpaid leave during a single 12-month period to take care of your military relative if he or she has a qualifying serious injury or illness.

6323 (a) authorizes 120 hours (15 days) of military leave per fiscal year (FY). This type of military leave is applicable to members of the Army, Naval, Marine Corps, Air Force, or the Coast Guard Reserves, including the National Guard of the District of Columbia (DC).
