The Record on Appeal consists of copies of the papers that the appeal is about. The Record may include everything that the lower court considered when making the decision if you are using the Full Record Method.

The trial court keeps a record of all the documents and oral proceedings for each case, but the trial court does not automatically send its record to the Court of Appeal. The record on appeal contains the parts of the trial court record that the parties choose to send the Court of Appeal.

A court order may be upheld, overturned, modified, or remanded by appellate courts. When the higher court rules that, the lower court's decision is invalid and reverses it, this is known as a reversal.

The record in an appeal is the official account of what went on at the hearing or the trial that is being appealed. A party designates the record by listing what items to include in a Notice Designating Record on Appeal form (Sample Form F).

The “Record on Appeal,” as it is often called, includes everything that was presented at your trial as well as a transcript of the trial. That includes original legal documents filed with the court, exhibits submitted during the trial, and a full transcript of the trial proceedings.

After the appellant serves its notice designating the record, you have 10 days to tell the Superior Court what additional documents or exhibits you want in the record that will be sent to the Court of Appeal. (CRC rules 8.122(a), 8.130(a).) This is called the Respondent's Notice Designating Record on Appeal.

In most civil appeals, you must designate the record on appeal. "Designating the record" means that you must let the superior court know what documents and oral proceedings, if any, to include in the record that will be sent to the appellate court.
