To ask a judge to cancel (set aside) a Voluntary Declaration of Parentage or Paternity (VDOP), you fill out and file a court form. When you file the form, the clerk will give you a court date (a hearing date). At the hearing, you and the child's other parent will both get the chance to speak to the judge.

A person who has signed a voluntary declaration of parentage or paternity, or another interested party, may ask that the declaration be canceled (set aside) by filing a completed Request for Hearing and Application to Cancel (Set Aside) Voluntary Declaration of Parentage or Paternity (form FL-280).

To cancel it, within 60 days of signing: Fill out a California Voluntary Declaration of Parentage (VDOP) Rescission (form DCSS 0915) Sign the form in front of a Notary. Make 2 copies of the form. Send a copy of the signed form by certified mail to the other parent (keep the other copy for your records)

Parents can sign a VDOP at the hospital when the child is born. The hospital will have the form. If the parents sign at the hospital, both parents' names will go on the child's birth certificate.

A name on a birth certificate does NOT legally establish parentage. Only a court order or the Voluntary Declaration of Parentage (VDOP) establishes legal parentage. It's easy to establish legal parentage without going to court—and it's free!

Supplemental Declaration (drafted document, (blank form MC-030) – If you have already filed paperwork with the courts and wish to add additional information to be considered at a custody hearing, you must file a Supplemental Declaration at least five court days before the hearing.
