The term of copyright for a particular work depends on several factors, including whether it has been published, and, if so, the date of first publication. As a general rule, for works created after January 1, 1978, copyright protection lasts for the life of the author plus an additional 70 years.

There isn't a register of copyright works in the UK. You automatically get copyright protection when you create: original literary, dramatic, musical and artistic work, including illustration and photography. original non-literary written work, such as software, web content and databases.

Fair use is the right to use a copyrighted work under certain conditions without permission of the copyright owner. The doctrine helps prevent a rigid application of copyright law that would stifle the very creativity the law is designed to foster.

To copyright your name under common law, you need to show that you use it as a trademark and that it has acquired a second distinct meaning. Essentially, your name must be recognizable to the public as your brand name rather than your personal name.

In civil law countries, the rights usually belong to several physical persons, who have contributed to the creation of the film, while in common law countries the producer is generally the only copyright owner. An orphan work is a copyright protected work for which rights- holders are unknown.

"Common law" copyright referred to federal and state judicial rulings that protect works in the absence of legislation until they were published. Copyright officially became law when Congress passed the 1976 Copyright Act.

At common law, copyright rights vest in the author of the copyrighted work. They protect what are called “original works of authorship” like literary, musical, and other types of artistic work as long as they are fixed in a tangible medium (such as paper, canvas, or a recording).
