A “Massachusetts Uniform Citation” is a ticket issued for a traffic violation by a police officer or Massachusetts State Trooper. While all Massachusetts Uniform Citations were previously hand-written, electronic citations are becoming increasingly common.

A citation is a written notice to appear in court or respond by mail to answer a charge. Citations are a substitute for an arrest when the offense is minor, for example, a traffic violation.

A summon is a court order to an individual to appear in court at a specified time and place. A summon may be issued in both criminal and in civil cases. Every summon shall be served by a police officer, or by an officer of the court issuing it or any other public servant.

Citations are typically issued for non-violent offenses, such as driving on a suspended license or possession of a small amount of drugs. But even though you may receive a citation without being arrested, it is still a criminal charge which can lead to a conviction, jail time, fines, and a permanent criminal record.

The summons is issued by the court in a civil case to acquire jurisdiction over the person of the defendant or the person being sued. This allows the defendant to participate in the court proceedings, and be subject to its processes and judgments. Essentially, it satisfies the requirement of due process.

Citations refer to parking tickets, while a summons is a notice to appear for a criminal offense, he said.

A summons is a court form which notifies the defendant that they are being sued and lists the day the defendant needs to appear in court (the Return Date). The court has no power to hear a case until the defendant is served the summons and complaint.
