There are generally two ways for a couple to end a marriage in South Carolina: divorce and annulment. Divorces can only be granted on specific grounds allowed by statute, and those grounds are one-year continuous separation, adultery, physical cruelty, habitual drunkenness or drug use, and desertion.

File a “Complaint for Annulment” with the local circuit family court in the county where your spouse currently resides. Include the following information in your complaint for annulment: The date of your marriage. The city, county, and state where your wedding took place.

To have your marriage annulled, South Carolina courts require you to provide a legally valid reason for the annulment. Common grounds for legal annulment in South Carolina include: One spouse was under duress. A marriage may be annulled for duress if one person forces or pressures another person into the marriage.

Based on the Family Code, the grounds for annulment are lack of parental consent, insanity/psychological incapacity; fraud, force, intimidation, or undue influence; impotence; and sexually transmissible diseases.

(2) Where either party was 16 or 17 years of age and lacked the consent of parent or guardian or express authorization of the court and has not subsequently ratified the marriage upon reaching 18 years of age and an action for annulment is commenced within 60 days after the marriage ceremony.

Under Florida annulment law, once people are legally married, it can only be terminated by death or court order. Once a marriage is void, the court can terminate the marriage by issuing either a dissolution of marriage (divorce) or annulment.

Under Pennsylvania law, a marriage can be annulled for four reasons 1) one of both spouses' mental state was impaired when they married, 2) one or both parties were unable to give valid consent to the married 3) the marriage is illegal and 4) the marriage cannot be consummated.

An annulment is a court ruling that a marriage was never valid. The most common ground for annulment is fraud and misrepresentation. For example, one person may not have disclosed to the other a prior divorce, a criminal record, an infectious disease, or an inability to engage in sex or have children.

What is the Process for Filing for an Annulment in PA? Either party can file for annulment under 23 Pa. C.S. § 3303, whether the marriage is “void” or “voidable.” The process for filing simply requires submitting a request with your local courthouse to annul the marriage.

An annulment refers to a Court Order declaring that a marriage is void. In other words, an annulment is a declaration that the marriage never legally existed. A divorce, on the other hand, is a Court Order or Decree declaring that the parties are no longer bound by an otherwise valid marriage.
