The New York Wage Theft Prevention Act was passed in 2011 and is designed to protect employees from wage theft. The law ensures that employers provide written wage notices and pay stubs or risk penalties of up to $20,000 per infraction (New York Department of Labor).

Section 195.5 of the Labor Law states: Every employer shall notify his employees in writing or by publicly posting the employer's policy on sick leave, vacation, personal leave, holidays and hours.

What is wage theft prevention notice? The NY Wage Theft Prevention Act requires employers to give written notice of wage rates to each newly hired employee. The notice must include the following: Rate of pay, including the overtime rate of pay if the employee is eligible for overtime.

New York Labor Law Section 195.1 requires employers to obtain signed acknowledgements of receipt from newly hired New York employees that those employees have received written notice of their pay rate and pay day and if applicable, their overtime rate, before commencing work.

Employers that do not give wage statements may have to pay damages of up to $250 per day, per employee, unless they paid employees all wages required by law. (This stops at $5,000 per employee in civil lawsuits filed by employees.)

Notice and Acknowledgement of Pay Rate and Payday Under Section 195.1 of the New York State Labor Law Notice for Exempt Employees LS 59 is a blank work agreement that contains all of the fields that employers must include to notify each employee in writing of conditions of employment at time of commitment to hire.

Section 195. Notice and record-keeping requirements Every employer shall: 6. notify any employee terminated from employment, in writing, of the exact date of such termination as well as the exact date of cancellation of employee benefits connected with such termination.

No employer shall make any charge against wages, or require an employee to make any payment by separate transaction unless such charge or payment is permitted as a deduction from wages under this Part or is permitted or required under any provision of a current collective bargaining agreement.
