§ 55-225.12 controls with respect to non-VRLTA leases. Both statutes allow a tenant to assert the existence of a condition that constitutes material non-compliance with the terms of the lease, a fire hazard, or a serious threat to the life, health, or safety of the tenant and to seek redress from the court.

Code § 55.1-1254. If any items of personal property are left in the dwelling unit, the premises, or any storage area provided by the landlord after the rental agreement has terminated and delivery of possession has occurred, the landlord may consider such property to be abandoned.

Provide written notice to your landlord of the need for repairs. Give your landlord 14 days to start the repairs. You must give your landlord reasonable access to your home to do the repairs. If your landlord does not start repairs within 14 days, you can contract with a licensed contractor to do the repairs.
