Failure to Return the Deposit by the Landlord If you fail to return the amount within the 45 days upon tenant move-out, Virginia law states that you may face a number of charges such as meeting costs of the suit and reasonable attorney fees, as well as paying back the amount withheld.

Once you move out, the landlord usually has 45 days to return the deposit, plus any interest if due, unless there are deductions that the landlord is allowed to take from the deposit.

Your landlord must return your deposit within 10 days of you both agreeing how much you'll get back. If you're in a dispute with your landlord, then your deposit will be protected in the TDP scheme until the issue is sorted out.

If your landlord holds your deposit (so should be protected in the Insured scheme), the landlord should pay your deposit back within 10 days of your request for the deposit to be returned. A tenant cannot request the return of their deposit before the tenancy ends.

During the 45 days after you move out, the landlord can use all or part of the deposit for damages that you caused to the property, as long as the damages are not "reasonable wear and tear." For instance, if you lived somewhere for a long time, the carpet may not look new any more and the walls may need to be painted.
