A single act of adultery is a sufficient basis on which to bring a divorce action. And technically speaking, as long as the adultery was committed by one of the spouses, the other spouse has legal grounds under the Divorce Act to proceed with a petition.

You will get less money in the divorce if you admit to committing adultery. The procedural aspects of divorce and the financial aspects are completely separate. Although you must give an acceptable reason for your divorce to be successful procedurally, it rarely affects the outcome of the financial settlement.

You need to file the affidavit with the court to complete your filing. If you are seeking an uncontested divorce, things should move fairly quickly. It may take as little as three or four months – or even less – before the divorce is finalized.

Technically, as long as the adultery was committed by one of the spouses, the other spouse has legal grounds under the Divorce Act to proceed with a petition. It is a personal decision whether or not the spouse actually wants to do so in light of prospects of forgiveness and reconciliation.

Though adultery can be a ground for divorce, it will not affect spousal support, property division, child custody, or visitation rights. Note that the amount of spousal support (contrary to what some people believe) won't double up because of a partner's infidelity.
