A legal agreement can be informal, meaning nothing needs to be witnessed or written down. A contract, on the other hand, is both more formal and legally binding—which means it must be documented. Both an agreement and contract represent specific arrangements between two or more parties.

Under Georgia law, all these agreements are treated synonymously. When a seller of real estate agrees to finance some or all of the purchase price to the buyer, he may use a contract for deed.

A contract must be executed as a deed where there is no “consideration,” or exchange of something of value between the contracting parties. Consideration will almost always be present in an employment context as the employee will be providing their labour in exchange for wages from the employer.

The following should be in a contract for deed: Purchase price. Interest rate. Down payment. Number of monthly installments. Buyer and seller information. Party responsibilities. Legal remedies in the event of default.

The legal term “contract for deed” refers to a real estate transaction that takes place directly between the buyer and the seller, with no lender involved. It is also known as an installment purchase contract, installment land contract or bond for deed.

An agreement for deed is often referred to as "land contract." This arrangement is where a seller provides owner financing to a buyer. In turn, this allows a buyer to make monthly payments to the seller (instead of a bank). The seller will transfer the property title once receiving a certain amount of money.

A deed is a formal legal document (which is always written) that confirms an agreement between parties whereby an interest, right or property, or a binding obligation is created or confirmed.

A deed of termination intended for use when the parties wish to bring a contract to an end. It provides various options for dealing with the parties' accrued rights and liabilities under the contract being terminated.
