The purpose of Local Law 61 is to ensure that safe work practices are used when handling mold and to deter landlords from performing mold assessment, abatement, or remediation work in a manner that could threaten public health.

New York City Regulations require the landlord to inspect every room in the dwelling unit. The inspection must include the visual review of each and every surface in the apartment including the interiors of closets and cabinets. This inspection must occur at least once a year.

Are homeowners required to clean up mold in NY State? No. New York State law says that homeowners do not need to do anything about mold.

In most cases, it is the landlord's responsibility to address black mold in an apartment. Landlords have a legal obligation to provide tenants with a safe and habitable living environment, and this includes addressing issues such as black mold.

Sign the Affidavit(s) of Compliance in front of a notary public, who must also sign and affix his or her stamp on the form. Submit documents to the HPD office in the borough where the building is located. The violations will be dismissed once an inspection verifies correction if the paperwork provided is sufficient.

New York City law requires all private building owners with three or more apartments to keep their tenants' homes free of pests and mold. The law also applies to property owners of housing units (such as co-ops, condos, shelters or public housing) where a tenant has asthma.
