If you received Medicaid long-term services and supports, the state of Texas has the right to ask for money back from your estate after you die. In some cases, the state may not ask for anything back, and the state will never ask for more money back than it paid for your services.

MERP does not place liens on assets before or after the death of a Medicaid recipient. MERP only recovers the cost of certain long-term-care services that a Medicaid recipient receives after the age of 55.

The estate recovery contractor will send a Notice of Intent to File a Claim (NOI) within 30 days of when they receive notice of the death of a Medicaid recipient.

The Texas Department of Aging and Disability Services (DADS) can make a claim for reimbursement for certain Medicaid benefits for recipients who were 55 years or older at the time of death. Through the MERP program, DADS will send a Notice of Intent to File a Claim within 30 days of the date MERP learns of the death.

Medicaid cannot recover from property that is exempt from creditors (e.g. homestead property). Medicaid cannot recover from an estate under probate if the Medicaid estate recovery would result in an undue hardship for qualified heirs. In Florida, Medicaid can only recover from the probate estate.

The primary way to avoid probate for a house and ultimately avoid the enforcement of a MERP claim on the family home is called a Lady Bird Deed or Enhanced Life Estate Deed. It offers Texas residents a simple, inexpensive way to transfer real estate at the time of death, without probate.

A MERP claim may only be brought under the “administration of an estate,” which has a statute of limitations in Texas of four years. After that time, an administration is barred by statute; therefore, a MERP claim is too. Let's say you are averse to using a Lady Bird deed; maybe it sounds fishy to you.
