Almost all real estate sales in Washington State require a seller disclosure statement to be given to the buyer. Home sales, including condominium units, are included in the types of sales requiring a seller disclosure statement. The statute (RCW 64.06.

A Seller's Disclosure is a legal document that requires sellers to provide previously undisclosed details about the property's condition that prospective buyers may find unfavorable. This document is also known as a property disclosure, and it's important for both those buying a house and for those selling a house.

Examples of material facts that must be disclosed include structural problems with the house, soil problems, a leaking roof, unpermitted construction, neighborhood noise problems, and anything else that a buyer would deem to be important.

Any seller who intends to transfer any interest in real property shall disclose to the buyer any material defects with the property known to the seller by completing all applicable items in a property disclosure statement which satisfies the requirements of section 7304 (relating to disclosure form).

Each disclosure form requires the seller to state whether they have title to the property, and whether the title is subject to any adverse interests, such as a right of first refusal, an option, a lease, or a life estate. Encroachments, boundary agreements, and easements must also be disclosed.

Like any other state, the Washington law requires home sellers to disclose any known major defects that could affect the buyer's decision to purchase the house. These are major to minor defects—and even features—that the buyer should know before signing any contract.

Washington state does not require disclosure of death on a property.

Most, but not all, sellers of real estate in Wisconsin are required to submit a real estate condition report to any potential buyer. (See Chapter 709 of the Wisconsin Statutes.) The law doesn't, however, apply to multi-unit properties (more than four dwelling units).
