A Service members Civil Relief Act affidavit is a document litigants can take to court to prove they have checked to see if the defendant in their case is on active military duty. An SCRA affidavit, which most courts require, helps move cases forward so plaintiffs can get restitution more quickly.

A motion for default judgment may be asked for when a defendant does not file a responsive pleading within twenty-one days after being served.

SCRA Eligibility The SCRA covers all active-duty service members, reservists and the members of the National Guard while on active duty. The protection begins on the date of entering active duty and generally terminates within 30 to 90 days after discharge.

The SCRA is a law created to provide extra protections for servicemembers in the event that legal or financial transactions adversely affect their rights during military or uniformed service. These protections enable servicemembers to devote their entire energy to the defense needs of the Nation.

An Affidavit of Military Service is required in every case where the Defendant has not filed an answer or appearance. The purpose is to protect the men and women serving in the U.S. military from having a court judgment entered against them without first receiving notice of the lawsuit and a chance to defend the case.

In 1940 Congress created the Soldiers and Sailors Civil Relief Act (SSCRA) providing expanded rights, benefits, and protections for the servicemember. As the SSCRA, now SCRA, has been modified and amended, its purpose has remained substantially unchanged.
