These are short-term orders intended to stop violence and abuse by placing restric- tions on the respondent's actions until a hearing may be held by the court, usually within 14 days. Long-Term Protective Orders. Domestic violence orders (DVO) and inter- personal protective orders (IPO) can last up to three years.

You will have a court date, which is listed on form CH-109. Make sure to go to your court date if you do not agree to the restraining order. At the court date, a judge will decide whether to grant a restraining order against you that can last up to five years.

Anyone seeking such an order must be prepared to present some evidence in addition to their own written statements and testimony in Court. This standard means that the Court must see photographs, text messages, e-mails or any other physical evidence that can support claims made by the Petitioner.

There are no fees for filing for a domestic violence restraining order (DVRO) or for any forms related to the petition. You do not need a lawyer to file for a DVRO.

The law requires that the abuser be given formal notice that you have filed for a restraining order. Your forms can be personally served by anyone over 18 years of age who is not involved in your case,1 such as a friend, a relative, law enforcement or a professional process server.

2.3. A person can ask for a civil harassment restraining order if: the person is being harassed, stalked, abused, or threatened by someone else, and. the person is not in a close relationship with the restrained party (as with domestic violence restraining orders).

Generally, you must pay a $395.00 fee to file the Request. If the harassment has included violence or threats of violence, however, there is no filing fee pursuant to California Code of Civil Procedure section 527.6(p).
