"Drug dependent person" means any individual who unlawfully and habitually uses any controlled substance to endanger the public morals, health, safety, or welfare, or who is so dependent upon the use of controlled substances as to have lost the power of self-control with reference to the individual's dependency.

The crime of possession of a controlled substance with intent to distribute is a second-degree felony under Utah Code Ann. §§ 58-37-8(1)(a)(iii). In Utah, the crime of possession with the intent to distribute a controlled substance is punishable in the same manner as a charge of drug distribution.

Utah Code Ann. § 58-37-8(1). It is unlawful in Utah possess or use a controlled substance except pursuant to a valid prescription. Violation of this law may result in charges running from a class B misdemeanor to second degree felony depending upon the quantity of drugs within the individual's possession.
