When a creditor gets a judgment against a debtor, the creditor has to take steps to get the judgment paid. This process is called execution. Execution usually means that an officer of the law comes to the debtor's home or workplace to take things the debtor owns. The items that are taken are sold to pay the judgment.

What happens during an arraignment in Texas is that the judge will ask you if you want to be appointed a lawyer after the charges are read. If you qualify for court-appointed counsel, the judge will appoint your representation. Then, you get the opportunity to enter a plea against the charges filed against you.

WAIVER OF ARRAIGNMENT. An attorney representing a defendant may present a waiver of arraignment, and the clerk of the court may not require the presence of the defendant as a condition of accepting the waiver. Added by Acts 2001, 77th Leg., ch. 818, Sec. 1, eff.

Requesting a Writ of Execution Another way a creditor may try to collect their judgment is through a writ of execution. Requesting a writ of execution from the court would allow the debtor's non-exempt property to be seized and sold with the proceeds going to the debt owed to the creditor.

A Writ of Execution may be obtained thirty days after the Judgment is signed. This document authorizes the Sheriff to seize any non-exempt assets belonging to the defendant that are subject to the Writ. Those assets are then auctioned at a public sale and the proceeds are applied to the judgment.

If a defendant does not pay a judgment, the plaintiff can try to enforce the judgment by filing another lawsuit. For example, if the defendant owns several cars, the plaintiff can sue to have the car transferred to the plaintiff.

Any commissioned officer may order any enlisted person into pretrial confinement. Confinement may only be ordered when there is a reasonable belief that (a) an offense triable by court-martial has been committed; (b) the accused committed it; and (c) confinement is necessary under the circumstances.

While some property is exempt from garnishment in Texas, such as wages, other property such as bank accounts and stocks may be subject to garnishment. The garnishment of a bank account is also commonly referred to as a bank levy.
