Maryland Workers' Compensation Requirements In Maryland any business who employs workers must get workers' compensation. A Sole Proprietor or Partner is excluded from coverage by default, but can elect to be included. Corporate officers are included for coverage, but can elect to be exempt.

With few exceptions, every employer in the State of Maryland with one or more employees is required by law to provide workers' compensation coverage for their employees.

What workers' comp provides. Winning Maryland workers' comp claims generally cover lost wages and medical expenses of employees who sustain work-related injuries or develop occupational illnesses as a result of doing their jobs. In some cases, it also pays for vocational rehabilitation and death benefits.

Intentional acts: When a worker intentionally causes their workplace injuries or illnesses, they are not covered under a workers' comp insurance policy. Illegal activities: Employee injuries due to illegal activities at the worksite are not covered by an organization's workers' compensation insurance policy.

The Employee must file Employee Claim Form C-1 and a physician's report, if available. You can complete the form online or request a print form from the Workers' Compensation Commission. For most accidental injuries not ending in death, employees have 60 days to file a claim.

Who is Exempt from Workers' Comp Coverage in Maryland? While almost all employers in Maryland must provide workers' compensation coverage to employees, there are some exceptions. Businesses do not have to provide workers' compensation benefits to independent contractors or self-employed workers.

Every year, the Maryland workers' compensation rates are (supposed to be) adjusted for inflation. For 2021, the rates are as follows: Temporary Total Disability – 2/3 of the average weekly wage, not to exceed $1,050/week. Permanent Total Disability – 2/3 of the average weekly wage, not to exceed $1,050/week.
