You have two options for attempting to collect what a small claims court judge deems that you are entitled to: Garnishment of wages or bank accounts. Seizure and sale of personal property (i.e. motor vehicle, snowmobile or boat), or a registration against land.

If no Defence is filed within 20 days After you ask the court to have the defendant noted in default, you can ask the court to order the defendant to pay you what you are asking for. This is called a default judgment.

If the defendant does not file a defence If the defendant fails to file a defence with the court and at least 20 days have passed since you served the claim, you can fill out and file a Request to Clerk [Form 9B] asking the clerk to note the defendant in default.

Ask the court to have the defendant “noted in default” by filing a Request to Clerk (Form 9B). You can do this online if you filed your claim online and no other documents have been filed directly with the court.

Does my Judgment Expire? If you obtained a judgment by an Ontario court or tribunal on or after January 1, 2004 that judgment never expires. See the Limitations Act, 2002, Section 16(b). Some judgment procedures require a judge's order to allow you to enforce a judgment more than six years old.

If the debtor does not pay the money owed, you will have to take steps to collect it. Taking steps to collect on a judgment is called enforcing a judgment. More information about judgments can be found from the Ministry of the Attorney General.
