Can I get a pension sharing order after decree absolute?

A pension sharing order cannot be made on divorce until the granting of the decree nisi. ... It is only when the decree absolute is granted and the divorce is made final that the order takes effect and it will no longer be possible to vary the pension sharing order.

This means that a Respondent needs to give reasons to the judge why the application needs to be granted. Where there is a delay of 12 months or longer from the pronouncement of the decree nisi of divorce to the application for a decree absolute, either party to the marriage can still apply for the decree absolute.

A pension sharing order offers a clean break for all parties. It sets out how much of your pension(s) your ex-spouse or partner you will receive. The pension you receive from your ex-partner or spouse may be transferred to a new or existing pension scheme, or it may remain in the original scheme.

What is a pension sharing annex? In basic terms, a pension sharing annex allows you to receive a share of your spouse's pension. It is an instruction to the trustees of a pension scheme to pass a 'pension credit' from the scheme member to the spouse.

Once the pension provider has received all the documents, it has four months from either the date of the Decree Absolute or, if later, seven days from the expiry of the time limit for appealing the financial order (usually 21 days) in which to implement the pension sharing order.

Can a pension that is already in payment be shared? Yes it can, however, the receiving spouse won't be able to take a pension commencement lump sum (currently 25% tax free) from any benefits on transfer.

The main purpose of pension sharing under the CPP is tax savings. CPP pension sharing is a form of income splitting. Pension sharing really only produces a tax savings if one spouse is receiving more CPP and is in a higher tax bracket than the other spouse.

To agree on a division of the pension pot, you need to apply to a court for a pension sharing order as part of your divorce. Once your marital assets have been assessed, the court will award a percentage of one party's pension value to the other party, which is then used to set up a separate pension.

A Pension Sharing Order only comes into effect on the later of the granting of Decree Absolute or 28 days from the date of Pension Sharing Order. If you complete the divorce before those 28 days have passed and the Pension Sharing Order has not taken effect, then any Pension Sharing Order cannot be enforced.

Although a pension sharing order cannot take effect during a divorce procedure until the decree absolute is granted, the provider of the pension arrangement then has another four months in which to implement the pension credit.
