The shoreland zone is land located with 1,000 feet of the ordinary high water mark of a lake, pond, or flowage, or within 300 feet of the ordinary high water mark of a river or stream, or to the landward side of the floodplain, whichever distance is greater.

The standard setback from any navigable body of water for new construction is 75 feet and is measured from the ordinary high water mark as established by either the zoning office or DNR.

SHORELAND ZONING REGULATES. LAND USE AND CONSTRUCTION. Each county has adopted regulations that meet or exceed minimum state standards to protect water quality, natural scenic beauty, recreation, navigation, and fish and wildlife. These regulations include: Setbacks for structures from property lines and waterways.

6.1 SHORELAND SETBACKS. (NR115. 05(1)(b)1) Unless exempt under section 6.1(1), or reduced under section 6.2, or increased under section 6.3, a setback of 75 feet from the ordinary high-water mark of any navigable water to the nearest part of a building or structure shall be required for all buildings and structures.

The Shoreland zoning ordinance is applicable to all: Lands within 300' of a river, stream, or the landward side of the floodplain. Lands within 1,000' of a lake, pond, or flowage.

Consistency with State Standards. Act 55 prohibits a county shoreland zoning ordinance from regulating a matter more restrictively than the matter is regulated by a shoreland zoning standard promulgated as an administrative rule by the DNR.
