It is the law in the State of California that a permit is needed to possess a desert tortoise, Gopherus agassizii, as well as any other species of Gopherus tortoise such as a Texas tortoise (G. berlandieri) or a gopher tortoise (G. polyphemus).

In California, it is illegal to sell, purchase, harm, take, possess, transport, or shoot a projectile at a tortoise (Gopherus) (California Fish and Game Code 5000). It is illegal to have a tortoise as a pet unless it was acquired prior to 1972. (California Fish and Game Code 5001).

The desert tortoise is a species that is protected under State and Federal Laws. It is illegal for anyone to take a tortoise from the desert, or to buy or sell one.

Successful completion of the Desert Tortoise Council's Introduction to Desert Tortoises and Field Techniques Course, or equivalent field experience; Minimum of 280 hours conducting desert tortoise surveys; and. Minimum of 280 hours conducting construction monitoring in desert tortoise habitat.

In California, Agassiz's desert tortoise is listed as Threatened under the California Endangered Species Act. In general, it is illegal to sell, purchase, harm, take, possess, transport, or shoot a projectile at Agassiz's desert tortoises in California, or to move them out of the State.

Found a Desert Tortoise? If it is in an undeveloped area, leave it alone. If it is in a residential area, away from natural areas, it is likely an escaped captive tortoise, and the CTTC should be contacted to try to find its owner through the Department's permitting program or to arrange for its adoption.

Desert tortoises are protected by federal law and should not be removed from the wild unless they are seriously injured. If you do find an injured desert tortoise, contact the California Department of Fish and Wildlife to report it.
