For school-aged children, programs "of an instructional nature" such as classes and camps, do not need to be licensed. However, after school childcare programs generally do need to be licensed.

(a) There shall be at least 35 square feet of indoor activity space per child based on the total licensed capacity.

To work in a licensed childcare facility, adults must obtain a criminal record clearance. Beyond minor traffic violations, adults with a prior criminal history can request a criminal record exemption if they have not been convicted of a felony or any crime perpetrated against children.

For a small family child care home, the maximum number of children for whom care shall be provided, including children under age 10 who live in the licensee's home, is: four infants; or six children, no more than three of whom may be infants; or eight children if at least two of the children are at least 6 years of age ...

Child care centers and family day care homes in California are required to be licensed by the Community Care Licensing Division of the State Department of Social Services. All programs must meet the regulations specified in Title 22 of the California Administrative Code, which is based on the Health and Safety Code.

If you are providing care for your children (or those of a relative), and children from only one other family then you do not need a child care license and you are legally exempt (license-exempt) from licensure requirements in California.

A small family day care home may provide care for up to eight children, without an additional adult present, if all of the following conditions are met: * At least two of the children are at least six years of age. * No more than two infants are cared for during any time when more than six children are cared for.

A license is required to operate in your home unless you meet the following criteria: Only caring for up to three children from one other family besides your own. Caring for up to 12 children for no payment; or. Related to all the children that are under your care.

Childcare licensing requirements in California Must be at least 18 years old. Must live in the home. Must have a clear criminal record. Must have a TB test. Must complete 16 Pediatric Health and Safety training hours from an Emergency Medical Services Authority (EMSA) approved vendor or accredited college/university.
