ing to the mechanics lien law, after your notices are served timely the lien must be filed in the county recorder's office in the county where the property is located. The lien may either be served by certified mail, return receipt requested, or personally served on each of the parties.

An Arkansas Pre-Construction Notice to Owner is an important requirement to remember when working on a residential project within the state. This serves to inform owners of these types of properties about the possibility of mechanics liens and the steps necessary to avoid them.

Filing of Mechanic's Lien. The general contractor must file a mechanic's lien with the registry that states the date when material was first and last furnished, legal description of the property, and name and address of the owner of the property and the tax parcel identification number.

In Arkansas, all mechanics liens must be filed within 120 days after last furnishing labor or materials. In Arkansas, an action to enforce a mechanics lien must be initiated within 15 months after the lien was filed.

For Residential projects, ARKANSAS Code Annotated §18-44-115 mandates that a Preliminary Notice To Owner (Residential) must be served to the Owner of a residential property being improved before labor or materials are provided for the improvement of the property. Delivery should be made in person or by Certified Mail.

Once filed, an Arkansas mechanics lien claim is only valid for a period of 15 months from the date the claim was recorded. Failure to file an enforcement action within that timeframe will cause the claim to expire, and no longer be enforceable.
