Tenancy Termination This is sometimes known as a notice to terminate. An eviction is a legal proceeding in which a landlord asks a court to order the tenant to leave the property. Giving a tenant a notice to terminate is often a first step in the eviction process, but it isn't the same as an eviction.

Components of the Letter Include your name and the rental address, and date the letter. Don't date it and hold onto it; date it for the day you are giving it to the landlord to start the 60 days. Address the letter to the landlord with a subject line of "60-Day Notice to Vacate."

Your name, and the landlord's name and address. The date you're writing the letter. Informing the landlord you're breaking your lease early. The reason why you're breaking your lease. The building and apartment you're vacating. The date by which you're vacating.

A Notice to Vacate is a notice written by the landlord or property manager giving a notice to leave the premises within a specified time frame. This type of notice is typically given during the end of a lease period, or due to an infringement of the lease agreement.

Dear (Name of landlord or manager), This letter constitutes my written (number of days' notice that you need to give based on your lease agreement)-day notice that I will be moving out of my apartment on (date), the end of my current lease. I am leaving because (new job, rent increase, etc.)

A termination of tenancy is different than an eviction. A termination is the landlord ending the rental agreement and asking the tenant to vacate the rental unit. An eviction is the actual court process and lawsuit to have a tenant removed from the property if they fail to leave.

The most effective way to serve a notice to quit is to send the notice via certified mail with a return receipt. After this is done, the notice to quit is also posted conspicuously on the property, such as on the front door or garage.

Assuming you are paying on the first of the month, your 30-day notice should be given 30 days before and specify the first of the month as the date you are out. For example, if you want to vacate in May, draft and deliver the notice before April 1 and list April 1 as the date the 30-day notice takes effect.

Eviction does not show up on your credit score, but it may appear on other consumer reports and make it harder for you to rent in the future. If you owe any unpaid rent or court fees, those debts can show up on your credit report and lower your credit score.
