New Hampshire Plaintiff's Voluntary Dismissal

When a defendant files a motion to dismiss, he asks the Court to throw out all or part of the plaintiff's case.The parties (well, their lawyers) will come to court, explain their positions on the motion to dismiss, and answer any questions posed by the judge. Finally, the judge will decide to grant or deny the motion.

Pursuant to Rule 1.420(a) of the Florida Rules of Civil Procedure ("the Rules"), a party may voluntarily dismiss a case without prejudice before trial by serving . . . a notice of dismissal at any time before a hearing on a motion for summary judgment, or if none is served or if the motion is denied, before retirement

If the Plaintiff does not show up for the trial and the Defendant does appear, if the Defendant asks, the Court may dismiss the case without prejudice.If the Plaintiff does refile the case and again fails to appear at trial, the Small Claims Rules say the Court may dismiss with case with prejudice.

Dismissal of Actions (a) Voluntary Dismissal. But if the plaintiff previously dismissed any federal- or state-court action based on or including the same claim, a notice of dismissal operates as an adjudication on the merits.

By Practical Law Litigation. A notice of voluntary dismissal which a plaintiff may use to dismiss an action before the defendant has answered or moved for summary judgment.

A request for involuntary dismissal can be made by a defendant through a motion for dismissal, on grounds that the other party is not prosecuting the case, is not complying with a court order, or to comply with the Federal Rules of Civil Procedure.

Some reasons a party might file a motion to dismiss include: The statute of limitations has expired. The court does not have jurisdiction over the parties or the subject matter of the case.The plaintiff failed to name a necessary party in the complaint, or named the wrong party.

A dismissed case means that a lawsuit is closed with no finding of guilt and no conviction for the defendant in a criminal case by a court of law. Even though the defendant was not convicted, a dismissed case does not prove that the defendant is factually innocent for the crime for which he or she was arrested.

A non-suit is a dismissal without prejudice to re-filing the case. A dismissal with prejudice means that the case cannot be re-filed. Usually, a non-suit is taken when parties do not execute a release. Take care.
