Introduction. The first thing that you should know is that debt collectors and creditors cannot take your income or property unless they sue you in court and win a judgment. Once a debt collector wins and gets a judgment, they may try to collect on that judgment by an account levy or wage garnishment.

In Montana, the statute of limitations on written contracts, obligations, or liabilities is 8 years. Verbal contracts, accounts, or promises have a statute of limitation of 5 years. As for verbal obligations or liabilities that are not contracts, these have a statute of limitation of 3 years.

If a debt collector shows up at your house, you don't have to open the door to them or let them in. If you ask them to leave, they have to go, and they can't take anything from your home either. If you talk to the debt collector, they need to show you ID if you ask.

Tenancy by the entirety. About half the states allow married couples to hold title to their principal residence as tenants by the entirety. Homestead exemptions. Qualified personal residence trust (QPRT).

Introduction. If you need to file civil court forms and documents in the NSW Local, District or Supreme Court, you can do this online via the Online Registry website. Alternatively, you can mail your documentation, or visit a court registry and deliver it in person.

To file your complaint, request a complaint form from the justice of the piece or clerk. There's a small fee to process and deliver the order to the defendant, but you may be able to request a waiver if you can't afford it. Pay your fee, fill out the form, and sign in front of the clerk or the justice.

You might get sued. The debt collector may file a lawsuit against you if you ignore the calls and letters. If you then ignore the lawsuit, this could lead to a judgment and the collection agency may be able to garnish your wages or go after the funds in your bank account.

If creditors apply to wind up a company it is the company's assets and property that are taken into account rather than personal money and assets. So creditors of the company shouldn't be able to force a sale of your home.

Bailiffs can include your vehicle in a controlled goods agreement, or they can tow it away or clamp it. They can do this if your vehicle is parked at your home or on a public road. But they can't take your vehicle if it's parked on someone else's private land, unless they have a court order allowing this.
