Montana Name Affidavit of Buyer

Most states require that all owners listed on the title must print and sign their name when transferring ownership. Any fields that require information about a buyer/purchaser/transferee are asking for information about the person you are selling or donating the vehicle to.

In simple situations where you own the vehicle outright and wish to transfer ownership to someone else, all you must do is complete a title certificate. Once you have filled out and signed the certificate, the buyer or recipient can take the title to a local DMV office and officially transfer ownership.

All fields must be completed in blue or black ink only. White-out or attempts to erase or scratch out entries void the title. The buyer's name and address must be written on the title, per Montana law.

Though your lien holder will receive a separate document verifying their connection to the loan, you will be in possession of the title itself. There are only nine title-holding states: Kentucky, Maryland, Michigan, Minnesota, Missouri, Montana, New York, Oklahoma, Wisconsin.

Montana requires that the seller(s) signature(s) on a Montana Motor Vehicle Title be notarized.If there are two or more owners listed on a title, they do not have to have their signatures notarized at the same time or by the same notary, but they must both be notarized.

Complete the back side of the title and fill in all required fields. Get the title notarized before giving it to the buyer. Work with the buyer to complete a bill of sale and have it notarized (with your signature and that of the buyer). Give the buyer a lien release.

The following line says Signature of buyer. The buyer should sign on this line. Next to that, the buyer should print their name. Note that if two people are taking ownership of the car, both people must fit their names on the same lines. The next line says Name of seller. The seller should print their name there.

Have both parties sign it, create a copy, and then send the bill of sale to the DMV. If anything happens and the buyer fails to register the car, you'll have the proof needed to say the car's ownership has been transferred and it is no longer in your name.
