Title deeds do not have to be recorded. Recording is filing them in the county recorder's office and if recorded, the title deed acts as defacto notice to all third parties as to ownership in the property.

Leases with an initial term not exceeding seven years are not required to be recorded so long as each renewal term under the lease (a) is for seven years or fewer, and (b) may be effected or prevented by a party to the lease or its assigns.

When the Land Records clerk is satisfied that the correct documents have been submitted, the clerk will accept the documents for filing. After your documents are recorded, the original deed will be mailed to you, which often takes 4-6 weeks.

When done properly, a deed is recorded anywhere from two weeks to three months after closing. However, there are many instances where deeds are not properly recorded. Title agents commit errors, lose deeds, and even go out of business. Even county offices sometimes fail to record deeds that were properly submitted.

Failure to record a deed effectively makes it impossible for the public to know about the transfer of a property. That means the legal owner of the property appears to be someone other than the buyer, a situation that can generate serious ramifications.

A consenting individual may be removed from a deed by filing a quitclaim deed. Under Maryland law each county has a separate procedure and requirements for filing a quitclaim deed.

Deeds can be viewed for free online through mdlandrec.net. You must create an account with the Maryland State Archives to view deeds on mdlandrec.net. Many courthouses also have computer terminals you can use to search or review deeds.

If you are adding your spouse or other party to the deed, put your name in the "Transferred From" line and place both your name and the other person's name in the "Transferred To" section. Failure to put your name in the "Transferred To" section will make the new person the sole owner of the house.

Recording a lease means that it (or a Notice of Lease) is submitted to the public record, usually at the local Registry of Deeds following the signing of it by both parties.Some states require that certain kinds or length of leases be recorded, so parties should review their applicable state laws.
