New Mexico Answer to Civil Complaint including Demand for Audio Recording

Provide the name of the court at the top of the Answer. You can find the information on the summons. List the name of the plaintiff on the left side. Write the case number on the right side of the Answer. Address the Judge and discuss your side of the case. Ask the judge to dismiss the case.

You can file an answer to respond to the plaintiff's complaint. An answer is a formal statement, in writing, of your defense to the lawsuit. You can say that what the plaintiff claims is not true. Or you can say it is true but give more information and reasons to defend your actions or explain the situation.

After you file an answer with the court, The court clerk will give the case a court date for you and the plaintiff to see a judge. The court will mail you the date.If your case is in small claims court, go to court on the date in the summons.

The name of the court - you can find this at the top of the Complaint you got. The Court Division - this is the county where the complaint was filed. The Docket No. The Plaintiff's name. The Defendant's name - your name. The kind of complaint you are answering.

WHAT HAPPENS AFTER I FILE MY ANSWER? Your Answer will go into the court's file. You have to keep one copy and send a copy of it to the attorney on the other side. The Clerk will then give you a date to come back to court or tell you that you will get a date in the mail.

The Answer is the court document that helps you tell your story to the judge. This Answer form includes basic Defenses and Counterclaims. Defenses are the legal reasons why you should not be evicted. Example: The landlord is evicting you for not paying the rent and you paid the rent.

The Reply is a legal document written by a Party specifically replying to a Responsive Declaration and in some cases an Answer. A Reply may be written when a Party or non-moving Party (the Party who is not requesting relief from the court) is asserting a counterclaim or the court has ordered a Reply.

To respond you must file a formal paper with the court. The paper is called the Answer. You cannot call the Clerk's office to get extra time to file an answer in a civil case. Only the plaintiff or the plaintiff's attorney can give you extra time (called an extension).

A Response or Reply to the Opposing Party's Pleadings is your answer to the opposing party's document filed with the Court.
