North Carolina 810.44A Wrongful Death Damages-Medical Expenses-Stipulation. (6/2013) is a North Carolina statute which sets forth the amount of damages for medical expenses that can be recovered in a wrongful death action. The statute stipulates that the amount of damages that can be recovered for medical expenses shall not exceed the amount that would have been paid for the medical treatment and services had the deceased not died. The statute further provides that damages for medical expenses shall be limited to the reasonable value of medical services, which includes the costs of hospital, nursing, and medical services, including the cost of drugs and medicines, and such other reasonable expenses as may be incurred in the care and treatment of the deceased. The statute also provides that no damages shall be awarded for medical expenses that are incurred after the date of death.
