What Happens at a Trial Setting Conference? The judge will ask questions about the case to ascertain whether it is ready for trial and how long the trial is likely to take. If the case is indeed ready to proceed to trial, the court will set a Mandatory Settlement Conference (or MSC) as well as a trial date.

A TRC is a hearing where the attorneys appear in court, exchange discovery (information about the case), and may try to negotiate a disposition of the case. If the attorneys cannot agree to a guilty plea they set a trial date. A TRC could take place several times prior to trial.

During the pre-trial conference, either side can file or set a date for filing motions, including a motion to dismiss the complaint or to prevent certain evidence from being used at trial. A Pre-Trial Conference Report must be signed by both sides, submitted to the judge, and signed by the judge.
