HB 321 signed into law in June of 2022 and was effective September 13, 2022 defined online auctions and requires an auctioneer or auction firm license under Chapter 4707 of the Ohio Revised Code unless an individual meets an exemption found with in ORC 4707.02(B).

Before the highest bid is accepted, a seller can withdraw the property from the auction. The auctioneer can withdraw property from the auction sale before the dropping of the gavel.

Ohio law provides that an auction is with reserve unless the terms and conditions of the auction expressly state that there is no reserve. That is, unless expressly stated otherwise, the auctioneer can withdraw the item being sold at any time up until the completion of the sale is announced.

To bid on site, bring a valid driver's license and complete the brief registration form. You will still need to show your valid driver's license as proof of identification. The process only takes a few minutes. Some auctions may require a bidder deposit to be made in advance of the auction.

Ohio law states that anyone who performs the function of an auctioneer or conducts an auction must be licensed under by the Ohio Department of Agriculture.
