The legal guardianship document is a formal declaration to the court system that another party is responsible for the well-being of the minors. No one can predict when an accident or other disaster may occur. Some include a legal guardianship document in their wills to determine who will raise their children.

A guardianship action is initiated with the filing of a Petition to Appoint a Guardian (the Petition) with the Court of Chancery (the Court). The requirements for the contents of the Petition are set forth in Chancery Court Rule 175.

You must give the Court a copy of the Complaint for each Defendant you are suing. When you file the Complaint and Praecipe, you will have to pay an $85.00 filing fee and any Sheriff's fees required for serving the Complaint. Once the Defendant(s) are served with the Complaint, the Sheriff will notify the Court.

You must also file an underlying petition, such as a Petition for custody, in order to file a Motion and Affidavit for Emergency Ex Parte Order. A Hearing Officer will review your Motion and Affidavit and determine whether an Emergency Ex Parte Order should be granted.

You can establish guardianship of a child by filing papers in court. Initially, file a petition stating your interest in obtaining guardianship along with a filing fee. You'll also want to file a letter of consent from the child's parents.

A guardian of property is someone the court names to manage money and property for someone else whom the court has found cannot manage it alone. Sometimes a guardian of property is also appointed as guardian of the person.
