A restraining order obtained after a hearing (different from an ex-parte order) will typically remain in effect for three to five years. The duration should be indicated in the order. If there is no termination date on the order, it is valid for three years.

A protective order and a restraining order are both similar in that they are orders that must be signed and approved by the Court. They offer protection to people but are often used interchangeably.

A restraining order can either last for a specific amount of time, or it can be issued for an indefinite period. The duration of the order will depend on the circumstances, the severity of actions and potential ongoing risk to the victim. The usual period for a restraining order runs between 10 days and one year.

It will not appear on your criminal record. However, if an AVO has been made against you, and you knowingly breach one of the conditions in the AVO, this will be a criminal offence.

The protected person can remove a permanent restraining order by filing a new petition with the court. However, removing a restraining order does not come without consequence: Judges are very leery of lifting restraining orders to guard the best interests of the protected party.

Restraining orders and civil protection orders may be ordered in a civil proceeding, whereas a temporary protection order arises out of a criminal proceeding. A restraining order must accompany an underlying lawsuit.A restraining order is an order requiring the parties to the lawsuit to do or not do certain acts.

A civil protection order does not automatically expire. That does not necessarily mean it is permanent, however. Either the protected party, or the restrained party, may seek to modify a restraining order pursuant to C.R.S. 13-14-108(2).

The Difference Between a Permanent Restraining Order and a Temporary Restraining Order.As the name suggests, this restraining order lasts forever, thereby barring the potential aggressor from harming the victim. In matrimonial practice, ex-husbands are the most frequent recipients of permanent restraining orders.
