Colorado Motion to Transfer Action to County Court

Each judge has her/his own habits and it's difficult to speak to the speed of a judge outside of my personal experience. But as a general rule, you can expect a decision in this type of matter in anywhere from 2 weeks to 3 months.

What is a venue transfer? When a judge transfers venue, your case is moved to a court in a different county. You can ask a judge to transfer venue by filing a Motion to Transfer Venue and Notice of Hearing.

The responding party shall have 21 days after the date of service of a motion, or such lesser or greater time as the court may allow, in which to file a response. The moving party may file a reply no later than 14 days after the date of service of the response, or such lesser or greater time as the court may allow.

Colorado is a serve-first state. In most states, the first step is filing the case with the court and then serving the defendant.

The judge will either grant or deny the motion. If it is granted, the case is over and the defendant wins. If the motion is denied, as it usually is, the defense is given the opportunity to present its evidence.

There's no exact time limit on how fast a judge must do his work. In the states and federal courts I am familiar with, the lawyer files a motion and sets it for hearing about six weeks later, more or less, depending on the court's docket.

Filing Your Motion. Take your motion to the clerk of court. You must file your motion in the same court where the related case is being heard if you want the judge to rule on it.

For a motion pursuant to C.R.C.P. 56, the moving party shall have 14 days after the filing of the responsive brief or such greater or lesser time as the court may allow to file a reply brief.
