Complete two court forms. Complete forms Verified Motion and Affidavit for Citation for Contempt of Court (JDF 1816) and Order to Issue Citation and Citation to Show Cause (JDF 1817). File the forms with the court. Notify the person who hasn't paid. Go to the hearing.

Typically, a person must file a motion for contempt of court. This does not create a new case. The motion is filed in the same county and court where the original order was entered. The moving party may also be required to file a declaration or affidavit with the court.

The judge will either grant or deny the motion. If it is granted, the case is over and the defendant wins. If the motion is denied, as it usually is, the defense is given the opportunity to present its evidence.

Depending on the infraction, contempt of court consequences can include fines, compensatory visitation, a modification to the custody arrangement, and in some instances even jail time. In most cases, if someone is held in contempt, the court will first give them the opportunity to make amends for the violation.

You have only 14 days to respond to a regular motion. The time to respond runs from the date the motion was filed. Check the certificate of service, which should be included with the Motion papers. If you need to respond to an Administrative Motion, you have only 4 days.

Go to the clerk's office at the court that made the orders. Give the clerk your completed Motion for Contempt and Appearance forms. The clerk will write a hearing date and time on the motion, sign it, and give it back to you. The hearing date is when you and the other person must go to court.
