Applying for probate in New South Wales All applications must be filed at the Supreme Court of New South Wales Registry, either in person or by post. The application must be accompanied by supporting documents including the will and death certificate, as well as an application fee.

In emergency situations, an ex parte motion provides an exception to the rules of due process by allowing you to petition the court without having to notify or serve the other parties involved in your case. If the judge grants the ex parte order, the order is only temporary.

Most states impose a deadline of ten to 90 days after the death, or after you receive notice of the death. The filing of the will starts the probate process.

Probate is generally required in North Carolina only when a decedent owned property in their name alone. Assets that were owned with a spouse, for which beneficiaries were named outside of a will, or held in revocable living trusts, generally do not need to go through probate.

In North Carolina, you can make a living trust to avoid probate for virtually any asset you ownreal estate, bank accounts, vehicles, and so on. You need to create a trust document (it's similar to a will), naming someone to take over as trustee after your death (called a successor trustee).

On the form, you state that the value of the estate's personal property (everything but real estate) is less than $20,000 (or less than $30,000 if the surviving spouse inherits everything under state law) and that at least 30 days have passed since the person's death.
