The rule of reason applies to postponing a court date. If the justification is reasonable, related to trial preparation, your health or that of a family member, or a matter of some importance scheduled before the court date was set, the judge will likely have no problem with a request for postponement.

If you want to change your court date, you must ask for a postponement (also called a "continuance"). Mail or personally give a copy of your Form SC-150 or letter to the other people named in the claim. You may have to pay a $10 filing fee to ask for the postponement.

The restrained person must be served before the hearing. If the restrained person wasn't served, fill out a Request to Continue Court Hearing and Reissue Temporary Restraining Order (Form DV-115 ) and a Notice of New Hearing and Order on Reissuance (Form DV-116 ) to ask the judge for a new hearing date.

The best way to win in a domestic violence restraining order case is to provide strong evidence that the petitioner is not being truthful. In these types of cases, the courts tend to side with the supposed victim of domestic violence, especially if other family members are in danger.

Greet the judge with a formal salutation such as "Dear Judge So-and-So" or "Your Honorable Judge So-and-So." Identify yourself and your reason for writing to the judge in the first line of the letter's body. For example, "My name is Jim Jimerson and I am writing to reschedule our evidentiary hearing."
