Notice Of Related Case

Courts have the power to consolidate cases that raise common questions of fact or issues of law for many purposes, including to hold a single trial. But consolidating cases, no matter the purpose, does not destroy the independent cases for appeal, according to a decision by the U.S. Supreme Court.

Under the proposed rule, cases would be deemed related only if they involve the same parties and one of the following: (i) the same or substantially similar issues of fact; (ii) the same occurrence, transaction or property; or (iii) insurance coverage for the same property, transaction or occurrence.

A case is related if it involves one or more of the same parties and common questions of law or facts. If a related case is indicated, the case shall be referred to the judge with the earliest filed case. That judge shall determine in his or her discretion if the case(s) should be considered related.

A "notice of filing" is a separate document that must, at a minimum, notify the recipient what it is that has been filed and the date of filing.104.01, subdivision 1, an appeal from an appealable order must be filed and served within 60 days after service by any party of written notice of the filing of the order.

Whenever a party in a civil action knows or learns that the action or proceeding is related to another action or proceeding pending, dismissed, or disposed of by judgment in any state or federal court in California, the party must serve and file a Notice of Related Case.

When the court rules on a motion or makes an order or renders a judgment in a matter it has taken under submission, the clerk must immediately notify the parties of the ruling, order, or judgment.
