Answer to Amended Complaint for Violation of Arkansas Lemon Law

There is NO Missouri law which gives a buyer the right to return a car or other large purchase for a full or partial refund.No store is required to give you your money back because you changed your mind or discovered later that you made a bad purchase.

Once a defendant has answered, a first amended complaint can only be filed and served with leave of court. If the plaintiff did not get the court's permission, it is not deemed a valid first amended complaint.

Any consumer who buys or leases, and registers a new motor vehicle in the State of Arkansas is covered by the Lemon Law. The consumer is protected during the term of the manufacturer's warranty for up to two (2) years after the original delivery date of the vehicle OR for the first 24,000 miles, whichever occurs last.

Is there a cooling off period on vehicle purchases in the State of Arkansas? Dealers are not required by law to give car buyers a three-day right to cancel. The right to return the car in a few days for a refund exists only if financing is not approved. However, some dealers may, by contract, offer a right to cancel.

(e) (1) In response to a demurrer and prior to the case being at issue, a complaint or cross-complaint shall not be amended more than three times, absent an offer to the trial court as to such additional facts to be pleaded that there is a reasonable possibility the defect can be cured to state a cause of action.

The defendant shall answer the amendments, or the complaint as amended, within 30 days after service thereof, or such other time as the court may direct, and judgment by default may be entered upon failure to answer, as in other cases.

Note the issue you're experiencing and check your warranty documents to see if they're covered. Look up the laws in your state. Report your problems to the dealership and manufacturer. Document everything, including repairs done by the dealer and manufacturer.

Missouri's lemon law protects owners of new motor vehicles. To receive benefits under Missouri's lemon law, you must provide the manufacturer and the dealer with notice of the vehicle's problem within one year of the purchase date. The manufacturer or dealer can perform the repairs outside of the first year.

The Missouri New Vehicles Warranty Law, commonly called the Lemon Law, protects buyers of new vehicles by enforcing the manufacturer's express warranty. The Lemon Law does not apply to used cars.
